What does it consist of?

Wills are documents in which a person establishes how they wish their assets and rights to be distributed after their death.

In addition, wills may contain personal provisions intended, for example, to protect minor children or a spouse.

In Spain, under the applicable legislation, there are legitimacy restrictions that limit the freedom of the testator; the most relevant, although not the only ones, are in favor of the testator’s descendants.

The law determining the existence of these restrictions is that which corresponds to the testator (nationality or civil domicile) at the time of death. If the testator does not have Spanish nationality, it is especially important to execute a will if they own property in Spain.

Finally, it should be noted that wills during a declared epidemic, while confinement obligations are in place, can be requested via videoconference.
